Verifying Identity and Eligibility for Employment

Form I-9 is from the USCIS (United States Citizenship and Immigration Services), a division of the U. S. Justice Department. Form I-9 must be completed electronically for all new hires (including U.S. citizens) within the first three days of employment.

Completing Form I-9 and E-Verify

Emory uses an electronic Form I-9. New hires complete the Section 1 portion of the Form I-9 on the New Hire Online Orientation website. An Emory Employee must complete Form I-9 Section 2 using the Pre-Start Service application (http://www.hr.emory.edu/Prestart). This form attests to facts about the applicant and requires the applicant to provide documentation for employer inspection. The employer should ask the new hire to read and complete the form immediately. See E-Verify Process for all EUV hires and Rehires.

Section 1 - Personal Information

The new hire completes Section 1 with the standard personal information during Online Orientation.

The new hire reads the statement for Section 1, electronically signs and dates the section during Emory Online Orientation.

Section 2 - Acceptable Documents

The new hire reviews the list of Acceptable Documents for Section 2 found on the back of the form.

The new hire provides an appropriate document from List A or one document from List B and one document from List C, and then presents the documents to the employer to view.

The employer inspects the documents provided by the new hire. (The employer may make photocopies of the documents.)

Fill in the Start Date for Section 2. The start date for the employee CANNOT be a date earlier than the Authorization Date issued by the USCIS (United States Citizenship and Immigration Services) on the supporting documentation for temporary aliens.

If the documents are acceptable, the employer completes Section 2 and signs the certification statement for Section 2 using the Pre-Start Service application at http://www.hr.emory.edu/Prestart.

The employer returns the original supporting documents to the new hire.

If the employer determines the supporting documents are unacceptable by the USCIS, the employer may ask the new hire to submit other documentation. The employer should not sign the certification until Form I-9 is complete and acceptable supporting documents are submitted.

The employer files the completed forms in a separate Form I-9 file.

Note: If someone other than the new hire translates and completes the form on behalf of the new hire, the certification (just above Section 2) must be completed, signed, and dated by the translator.

Section 3 - Only Required for Changes

The department representative and the employee complete Section 3 when:

  • an employee's name has changed,
  • an employee is a re-hire, or
  • the employee's work authorization has expired.
